Acceptable Use Policy

This Acceptable Use Policy (this “Policy”) describes prohibited uses of the web-based software, APIs, integrations, desktop tools, and related services offered by Onbrand Software, Inc. and its affiliates (“Onbrand,” “we,” “our,” or “us”), including the Onbrand PLM application and any related websites or services (collectively, the “Services”).

The examples described in this Policy are not exhaustive. We may modify this Policy at any time by posting a revised version within the Services or on our website. By using the Services, you agree to the most recent version of this Policy. If you violate this Policy, or authorize or assist others to do so, we may suspend or terminate your access to the Services.

No Illegal, Harmful, or Offensive Use or Content

You may not use, encourage, promote, facilitate, or instruct others to use the Services for any illegal, harmful, fraudulent, infringing, or offensive purpose, or to transmit, store, display, distribute, or otherwise make available content that is illegal, harmful, fraudulent, infringing, or offensive.

Prohibited activities and content include, but are not limited to:

  • Illegal, Harmful, or Fraudulent Activities. Any activities that are illegal, violate the rights of others, or may be harmful to individuals, organizations, or the integrity, operations, or reputation of Onbrand.

  • Infringing Content. Content that infringes, misappropriates, or otherwise violates the intellectual property, privacy, publicity, or proprietary rights of any third party, including copyrights, trademarks, trade secrets, or confidential information.

  • Offensive Content. Content that is defamatory, obscene, abusive, harassing, invasive of privacy, or otherwise objectionable, including content involving child exploitation, bestiality, or non-consensual sexual acts.

  • Harmful Content or Code. Content, files, scripts, or technologies that may damage, disrupt, intercept, or expropriate any system, program, or data, including viruses, malware, Trojan horses, worms, logic bombs, or similar malicious code.

  • Platform Compliance.  Any activity that violates the acceptable use policies, terms, or requirements of the infrastructure, cloud providers, or third-party services used by Onbrand, including but not limited to hosting, storage, compute, or messaging providers.

No Security Violations

You may not use the Services to violate the security or integrity of any network, computer, software application, or communications system (each, a “System”).

Prohibited activities include, but are not limited to:

  • Unauthorized Access.  Accessing, attempting to access, or using any System without authorization, including probing, scanning, or testing vulnerabilities or attempting to bypass authentication or security controls.

  • Interception.  Monitoring, intercepting, or collecting data, traffic, or communications from a System without explicit authorization.

  • Falsification of Origin. Forging, altering, or obscuring network packet headers, message headers, or metadata to misrepresent the origin, destination, or routing of any communication. Legitimate use of aliases or anonymization tools is permitted only where lawful and not deceptive.

No Network Abuse

You may not make network connections to users, systems, or networks unless you have permission to communicate with them.

Prohibited activities include, but are not limited to:

  • Monitoring or Crawling.  Monitoring, scraping, or crawling the Services or any connected System in a manner that disrupts, degrades, or interferes with normal operations.

  • Denial of Service (DoS).  Flooding or overwhelming a target with traffic or requests such that it cannot respond to legitimate usage.

  • Intentional Interference. Any deliberate attempt to interfere with the proper functioning of a System, including mail bombing, broadcast flooding, or similar attack techniques.

  • Operation of Certain Network Services.  Operating open proxies, open mail relays, or open recursive DNS servers using the Services.

  • Circumventing Restrictions.  Using manual or automated means to bypass usage limits, access controls, rate limits, storage restrictions, or other technical safeguards imposed by the Services.

No E-Mail or Messaging Abuse

You may not use the Services to distribute, publish, send, or facilitate the sending of unsolicited or unauthorized bulk messages, promotions, advertising, or solicitations (“spam”), including commercial or informational messages.

You may not:

  • Alter, forge, or obscure message headers

  • Impersonate another sender without explicit permission

  • Collect or process replies from messages sent in violation of this Policy or another provider’s acceptable use policy

Monitoring and Enforcement

We reserve the right, but do not assume the obligation, to investigate any suspected violation of this Policy or misuse of the Services. We may, at our discretion:

  • Investigate violations of this Policy

  • Remove, disable access to, or modify any content or resource that violates this Policy or any agreement governing use of the Services

  • Suspend or terminate accounts or access to the Services

We may report suspected illegal activity to appropriate law enforcement authorities, regulators, or other third parties. Such reporting may include disclosure of relevant customer or account information where legally permitted. We may also cooperate with investigations by providing relevant network or system information.

Reporting Violations

If you become aware of any violation of this Policy, you agree to promptly notify Onbrand and provide reasonable assistance, upon request, to help stop or remediate the violation.
